Room and Board are Student Loans in Bankruptcy

The Bankruptcy Appellate Panel recently issued a ruling that clarifies the classification of “room and board and miscellaneous fees” owed directly to a university. The court ruled that "room and board" debts fall under the exception to discharge under 11 USC §523(a)(8). Student loans are not generally not discharged in bankruptcy, and this decision expands the scope of what is considered a student loan.Score another point for student loan lenders.
